			<content:encoded><![CDATA[<p><img align="left" src="http://adotas.com/wp/wp-content/uploads/2006/02/scale.jpg" />A U.S. District judge ruled against Google this week in a case involving Google&#8217;s image search and adult website Perfect 10. Perfect 10 sued Google last year, saying that the thumbnail images provided by Google&#8217;s image search were a violation of copyright law. The judge granted a preliminary injunction against Google that will force them to stop caching and displaying 3,000 Perfect 10 thumbnails.</p>
<p>The judge said that the thumbnail images were a violation of copyright, particularly with Google&#8217;s mobile image search, which lets users save thumbnail images to their mobile phones. He also cited Google&#8217;s profitable search ads. Perfect 10 claims that the thumbnail images people can save to their mobile phones are nearly identical in size and quality to the images they receive through their mobile paid subscription service. However, the judge also said that Google&#8217;s habit of &#8220;framing&#8221; images from their search results was not a violation and consistent with fair use.</p>
<p>The lawsuit was also combined with one by Perfect 10 against Amazon&#8217;s A9 search engine, but the latter will be handled separately. Google says they will appeal the decision, and says that the judgment will have little effect on the way their image search works.</p>

			<content:encoded><![CDATA[<p>Google makes headlines again, but this time the news isn&#8217;t highlighting their exponential growth. The Bush administration has subpoenaed the search giant as part of a move to bring back a child pornography law that the U.S. Supreme Court struck down.</p>
<p>The subpoena, which was issued last year, requested a myriad of material from the company&#8217;s databases, including records of all Google searches from any one-week period and a request for 1 million random web addresses. Though the papers have officially been filed Wednesday in a San Jose federal court, Google has refused to comply on the basis of personal information and privacy protection.</p>
<p>The 1998 Child Online Protection Act, which would have punished violators with fines up to $50,000 or jail time, would have required adults to use access codes or other ways of registering before they could see objectionable material online &#8212; much of which they are finding through the search engine.</p>
<p>The data, if obtained by a federal court in Pennsylvania, would potentially help the government argue that a law would be more effective against child pornographers than a filtering software. Google has already said it will &#8220;vigorously&#8221; fight the governments push to obtain their data.</p>
<p>Nicole Wong, an associate general counsel for Google tells the AP, &#8220;Google is not a party to this lawsuit, and the demand for the information is overreaching.&#8221;</p>

To help you sort out all your questions, the FTC (in partnership with 13 private organizations and five federal agencies) <a href="http://onguardonline.gov/index.html" target="_blank">launched a website</a> yesterday to bring you up to speed.</p>
<p>Using interactive quizzes, the website educates on topics including ID theft, phishing, spam and online-shopping scams. Get the wrong answer and the site will explain in detail exactly why the consumer could be putting himself in harm&#8217;s way with such behavior.</p>
<p>&#8220;We&#8217;re trying to make the information as accessible as possible, with tips so people can take action,&#8221; Nat Wood, the FTC&#8217;s assistant director for consumer and business education, offered in a statement.</p>
<p>And for those who have already found themselves victims of Internet crime, the site also aims to help them find their way out of trouble: consumers can learn how to recover from identity theft, keep an eye on credit histories and find out how to create a safe password.</p>
<p>The OnGuard Online site is not copyrighted&mdash;in fact, the FTC is encouraging companies to download the information and spread the word. &#8220;The increasing concern about online threats is one of the reasons we could put together such a blue-chip coalition for a program like this,&#8221; says Wood. &#8220;E-commerce is great, but we just want people to have the tools to use it safely.&#8221;</p>
