ECPA Charge Against Interclick Dropped

gavel_small.jpgADOTAS – I knews they didn’t do it! Ad network interclick announced that charges of violating the Electronic Communications Privacy Act have been dropped from an ongoing class action suit against the company related to its online behavioral advertising.

After interclick filed a motion to dismiss, plaintiff Sonal Base amended its complaint, dropping the ECPA charge. It’s pretty big win for the network, and it will be interesting to see if it sets a precedent for the slew of behavioral-targeting-related legislation currently working its way through the legal system.

“interclick believes that our activities are not, and have never been, in any way unlawful and violated customer privacy,” said interclick CEO Michael Katz. “We are pleased that this important element of the litigation has been dropped.”
