Google Gets Setback In Patent Suit

patent11.jpgIt is being reported that a federal appeals court has given Google quite a setback in a patent suit this passed Wednesday. The court dismissed a piece of a summary judgement that was in favor of the company in a suit filed by Hyperphrase Technologies, LLC and Hyperphrase Inc. The companies claim that Google infringed on four patents that were used to create AdSense and AutoLink.

The original district court in Wisconsin ruled in favour of Google. However, the U.S. Court of Appeals for the Federal Circuit has said that it has partially vacated the summary judgement, partially upheld the summary and remanded the case.

The court agreed that AdSense and AutoLink did not infringe upon two of the four patents; however, the judgement on the remaining two was discarded and sent back to the Wisconsin district court.

The court wrote in its decision that “The district court’s grant of summary judgment is affirmed in part and vacated in par, and the case is remanded.” Google’s managing counsel for litigation Michael Kwun said of the decision in Reuters, “We’re very pleased that the Federal Circuit agreed that AdSense does not infringe any of Hyperphrase’s patents. We continue to believe the remaining claims in the lawsuit are without merit, and will vigorously defend against those claims.”
