Google Settles Clickfraud Suit
Back in February, Google was sued for click fraud liability in a class action suit headed by small business Lane’s Gifts. As of the end of last week, the final class action settlement was approved by the judge. AdWords advertisers received an email from Associate General Counsel Nicole Wong about the settlement. As promised in early March, when Google announced they were settling the case, Google has agreed to reimburse AdWords advertisers a collective maximum total of $90 million in AdWords credit.
“Now that the preliminary settlement has been approved by the Court, all members of the class are being notified about the settlement,” wrote Wong in the email, “…I recommend that you carefully review the information in the email and visit the site provided by the administration firm: www.clicksettlement.com. On the site, you will find links to the official settlement notice and settlement FAQs.”
The clicksettlement.com website is currently down, leaving the FAQ and official notice inaccessible, but Google is providing links to the click fraud management sections of the AdWords help center and the Inside AdWords blog.

I’m a lawyer at a small firm. I also do our firm’s SEO. We spend between 100k and 200k per year at Google. That’s a lot of money for us. That’s a lot of money, period!
We think the settlement is unfair.
Since our firm actually does this type of litigation, we will most likely opt-out and will sue Google individually in state court.
We may also take on clients who wish to do the same.
I suspect what will happen is that Google will end up paying more total money to those who have opted out. For example, if we recover 10 percent of what we spent, and there are another 1000 Google advertisers our size or larger, that apready puts Google’s obligations at 100 million USD for the opt outs alone.
